Di seguito sono riportati i termini che regolano l’utilizzo della piattaforma RunResell.com per offrire, trasferire e acquistare iscrizioni e pettorali per gare di corsa e altri eventi sportivi.
1.1 These Terms and Conditions (“Terms”) govern the rights and obligations between the operator of the RunResell.com platform (“Platform”) and its users (“Users”).
1.2 The Platform serves as a technical intermediary for the offering, transfer, and purchase of registrations, bib numbers, and similar participation rights for running races and other sporting events between Users.
1.3 The operator of the Platform is listed above.
1.4 The Platform is not the organizer of any event, not a provider of registrations, and not a party to any purchase agreement or other agreement concluded between the Seller and the Buyer, unless expressly stated otherwise.
1.5 The Platform acts exclusively as a technical and organizational intermediary enabling the publication of listings, communication between Users, payment processing through an external payment partner, dispute handling, and the provision of additional services.
2.1 User means a natural or legal person using the Platform.
2.2 Seller means a User who offers a registration, bib number, ticket, or other participation right for transfer or sale through the Platform.
2.3 Buyer means a User who purchases a registration, bib number, ticket, or other participation right through the Platform.
2.4 Registration means the right to participate in a running race, sporting or other event, including a bib number, application, reservation, or similar right of participation.
2.5 Transaction means the process including publication of a listing, reservation or purchase, payment, transfer of data or documents necessary for the transfer, and possible dispute resolution.
2.6 Payment Partner means Stripe and its affiliated companies, in particular services used through Stripe Connect.
2.7 Held Payment means the Buyer’s payment which, after payment, is temporarily suspended or otherwise not settled in favor of the Seller until the conditions of the Transaction are fulfilled or until a decision is made by the Platform or the Payment Partner.
2.8 Featured Listing means a paid additional service of the Platform that increases the visibility of a listing in the listing feed or grants it preferential placement.
3.1 The Platform serves exclusively as a technical intermediary between the Seller and the Buyer.
3.2 The Platform enables the publication and management of listings, contact and communication between Users, payment processing through the Payment Partner, transfer of data and documents required for the transfer, and handling of complaints, disputes, and suspected fraudulent conduct.
3.3 The Platform does not guarantee the successful completion of the Registration transfer, the authenticity, validity, transferability, or usability of the Registration, or that the organizer will recognize the transfer, change of participant, or any other requested action.
3.4 Both the Buyer and the Seller are independently responsible for reviewing the rules of the relevant event and organizer before entering into a Transaction, especially transfer conditions, name changes, time limits, fees, and other restrictions.
3.5 The Platform may edit, hide, make invisible, or remove a listing if it is incomplete, incorrect, misleading, in conflict with these Terms, or if there is a reasonable suspicion of fraudulent, unlawful, or otherwise improper conduct.
4.1 The use of certain Platform features may require the creation of a user account.
4.2 The User is obliged to provide truthful, complete, and up-to-date information and to update such information on an ongoing basis.
4.3 The User is responsible for protecting their login credentials and for all activity carried out through their account.
4.4 The Platform may temporarily restrict, suspend, or terminate an account if the User breaches these Terms, if there is suspicion of fraudulent or unlawful conduct, if the Platform is being abused, or if such action is necessary for security, operational, or legal reasons.
4.5 Restriction or termination of an account does not give Users any right to damages, reimbursement of costs, or refund of payments for additional services, unless these Terms expressly state otherwise.
5.1 Payments on the Platform are processed through the Payment Partner.
5.2 The Platform does not receive or hold Users’ funds as a payment service provider. Funds are processed within the infrastructure of the Payment Partner.
5.3 The User acknowledges that the use of payment features may be subject to the terms of the Payment Partner, including Stripe Connect, and agrees to comply with those terms.
5.4 Refunds, chargebacks, reversals, payment holds, delayed payouts, and other payment-related decisions may be subject to the rules of the Payment Partner, card networks, or other authorized entities.
5.5 In the event of a payment dispute, chargeback, reversal, refund, or similar claim, the Platform may suspend or delay payout, suspend the Transaction, restrict the user account, or take other reasonable protective measures until the matter is resolved.
5.6 The Platform is not responsible for the time required for processing payments, payouts, or refunds by the Payment Partner.
5.7 The Seller acknowledges that, in order to receive payouts, it may be necessary to complete identity verification and provide additional information as required by the Payment Partner, including KYC (Know Your Customer) and AML (Anti-Money Laundering) verification.
5.8 Until such verification is successfully completed, payouts to the Seller may be delayed, limited, or suspended. The Platform is not responsible for any delay or inability to receive funds caused by incomplete verification, incomplete Stripe Connect onboarding, unavailable payout methods, or restrictions imposed by the Payment Partner.
5.9 Without completing the required verification, the Seller may not be able to fully use certain features of the Platform, including receiving payments or payouts.
5.10 Identity verification and payout account verification are carried out directly by the Payment Partner. The Platform does not store the Seller’s identity documents, bank account documents, or other sensitive verification documents unless expressly required for a specific lawful purpose.
6.1 The Seller publishes a Registration listing on the Platform and is responsible for the correctness, completeness, and truthfulness of all stated information.
6.2 The Buyer makes a reservation or purchase and pays the price according to the Platform instructions.
6.3 After payment by the Buyer, the payment is temporarily held within the payment process until the conditions of the Transaction are fulfilled, the relevant period expires, or a decision is made by the Platform or the Payment Partner.
6.4 The Seller is obliged to initiate the Registration transfer and provide the Buyer with the necessary data, cooperation, or documents without undue delay, no later than within 48 hours from the moment the Seller is informed through the Platform, unless stated otherwise in a specific case.
6.5 The Buyer is obliged to take the necessary steps to complete the Registration transfer and provide cooperation if the transfer depends on the Buyer’s activity, no later than within 3 days from the delivery of the data or documents necessary for the transfer.
6.6 The Buyer is obliged, no later than within 3 days from delivery of the required data or documents, to confirm completion of the transfer or report a problem through the Platform.
6.7 If the Buyer does not report a problem within the period under Article 6.6, the Transaction is considered successfully completed and the payment may be released to the Seller.
6.8 The Transaction is also considered successfully completed when the Buyer confirms completion of the transfer through the Platform.
6.9 After confirmation or expiry of the review period without a problem being reported, the Transaction can no longer be cancelled and no refund may be requested unless the Buyer proves that the Registration did not exist, was not transferred, was invalid, materially did not match the description, or that the Seller did not provide the necessary cooperation.
6.10 Failure to use the Registration, delayed reaction by the Buyer, or lack of knowledge of the organizer’s rules does not give rise to any claim for complaint or refund.
6.11 The Platform may suspend payout or cancel the Transaction if the Seller fails to provide cooperation or required data in time, a dispute arises, there is suspicion of fraud, duplicate sale, invalid Registration, another breach of the Terms, or if required by the Payment Partner or by law.
6.12 The Platform reserves the right to modify the Transaction process, individual steps, and relevant time limits if reasonable for operational, security, or legal reasons.
7.1 The Seller must provide truthful, complete, and non-misleading information, have the right to transfer or sell the Registration, offer only an existing, valid, and not yet used Registration, disclose known or reasonably discoverable transfer restrictions, provide timely cooperation, data, and documents, and immediately inform the Platform if the Registration cannot be properly transferred.
7.2 The Seller must not offer or sell the same Registration simultaneously on multiple platforms or outside the Platform, offer invalid, non-existent, duplicate, already used, or otherwise defective Registrations, provide false information, or provide forged, altered, or misleading documents.
7.3 If a Registration is sold through the Platform, the Seller must refrain from any further handling of it that could endanger the Buyer’s rights.
8.1 The Buyer must provide truthful information necessary for the Transaction, pay the price and fees, check received data and documents without undue delay, cooperate with the transfer, and report any problem in time with available evidence.
8.2 The Buyer acknowledges that the transfer may be subject to organizer consent or rules, that the organizer may refuse, limit, or charge for the transfer, and that use of the Platform alone does not create any entitlement to participate in the event.
9.1 Registrations, bib numbers, and similar participation rights may not be transferable.
9.2 The Platform is not responsible for the organizer’s refusal of the transfer, inability to change the name or participant, organizer deadlines, organizer fees, or other restrictions arising from organizer rules.
9.3 Both the Buyer and the Seller must verify organizer conditions independently. If the Seller knew or could reasonably have known about a transfer restriction and failed to disclose it, the Seller is liable to the Buyer for that omission.
10.1 The Buyer may report a problem through the Platform functions.
10.2 The Platform may request evidence from both parties, including communication, confirmations, screenshots, emails, information from the organizer, and other materials relevant to the assessment.
10.3 The burden of proof regarding the existence, correctness, and transferability of the Registration lies primarily with the Seller; the Buyer must provide reasonable cooperation and substantiate relevant facts on the Buyer’s side.
10.4 The Platform acts as an internal dispute moderator and may, based on available evidence, decide on releasing payment to the Seller, refunding the Buyer, partial settlement, or another reasonable solution.
10.5 As part of the internal dispute resolution process, the Platform may decide the dispute in favor of the Buyer, in which case the payment may be refunded to the Buyer; decide in favor of the Seller, in which case the Transaction may be marked as completed and the payment may be released to the Seller; or return the Transaction to Buyer review, in which case the Buyer receives a new review period of 48 hours from the moment the Platform performs this action.
10.6 If the Transaction is returned to Buyer review, the previous review period is replaced by the new 48-hour period. If the Buyer does not report a problem within this new period, the Transaction may be considered successfully completed and the payment may be released to the Seller.
10.7 During dispute resolution, the Platform may suspend any payout or refund until a decision is made or until the Transaction is returned to Buyer review.
10.8 The Platform’s decision is binding for the functioning of the internal Platform system; this does not affect the parties’ right to refer the matter to a competent public authority.
10.9 If data or documents enabling the transfer or use of the Registration have been provided, the claim for refund may be limited or rejected, especially if the Seller fulfilled the Seller’s obligations and the problem did not arise due to the Seller’s fault.
10.10 The Platform is not responsible for the outcome of a dispute if either party fails to provide sufficient supporting materials or cooperation.
11.1 The Platform charges a commission of 6% of the Transaction price for a successfully completed Transaction.
11.2 Unless expressly stated otherwise, the commission is deducted when settling the amount in favor of the Seller.
11.3 If the Transaction is not successfully completed and the payment is refunded to the Buyer for a reason for which the Seller is not responsible, the Platform may decide that no commission arises.
11.4 The Platform may also charge other additional fees for optional services, especially Featured Listings or other forms of promotion.
11.5 Current prices of additional services are displayed at the time of selection.
11.6 The minimum commission per Transaction is 50 CZK or 2 EUR depending on the Transaction currency. If the calculated commission of 6% is lower than the applicable minimum, the minimum commission applies.
12.1 The Platform may offer paid additional services such as Featured Listings, preferential placement, top position, or other promotional display.
12.2 Purchase of promotion does not guarantee sale of a Registration, a specific number of views, clicks, messages, reactions, or successful completion of a Transaction.
12.3 The price of promotion is payable upon ordering unless stated otherwise.
12.4 Payment for Featured Listings or promotion is non-refundable.
12.5 No claim for refund arises if the User deletes the listing, the listing expires or is removed after sale, the listing is removed, hidden, or blocked due to breach of the Terms, the Transaction is cancelled due to the Seller’s failure to provide required data, documents, or cooperation, the listing is removed due to dispute resolution, security measures, suspicion of fraud, account restriction, invalidity, non-transferability, duplication, or other defect of the Registration, or if the Transaction is cancelled for any reason after promotion is ordered.
12.6 The Platform is not obliged to provide compensation for unused or interrupted promotion time.
12.7 The Platform may limit, terminate, modify, or cancel promotion without compensation if necessary for security, operational, or legal reasons or if the User breaches these Terms.
13.1 A User must not bypass the Platform and conclude or attempt to conclude Transactions outside the Platform after contact has been established through the Platform.
13.2 A User must not include contact details, links, QR codes, or any other information in a listing, description, messages, images, or otherwise that is intended to enable a Transaction outside the Platform.
13.3 A User must not abuse the Platform by providing false or misleading information, abusing the dispute or payment system, offering duplicate or invalid Registrations, or acting fraudulently, abusively, threateningly, or unlawfully.
13.4 The Platform may remove, edit, hide, or make invisible any content violating this Article and take measures against the relevant account.
14.1 The Platform is not responsible for cancellation, change, postponement, relocation, or interruption of an event.
14.2 The Buyer acknowledges that cancellation, change, or postponement of an event does not automatically create any claim against the Platform for refund.
14.3 If the organizer provides compensation, refund, or other performance, the relationship between Buyer and Seller regarding such performance is governed primarily by organizer rules and their mutual legal relationship; the Platform is not obliged to supplement such compensation from its own funds.
15.1 The Platform may carry out control measures for fraud prevention, user protection, and protection of its rights.
15.2 The Platform or Payment Partner may require identity verification, bank account verification, additional information, or further documents.
15.3 Until required verification is completed, the account, Transaction, or payout may be suspended.
15.4 In case of suspected fraudulent, unlawful, or risky conduct, the Platform may block or cancel a listing, suspend or cancel a Transaction, restrict or terminate an account, suspend payout, and disclose relevant information to competent authorities or the Payment Partner.
16.1 The User acknowledges that the Platform service is digital and may start immediately after the relevant action or payment is made.
16.2 The User agrees that the service may begin before expiry of the statutory withdrawal period and acknowledges that, under applicable law, the User may thereby lose the right to withdraw.
16.3 After successful completion of a Transaction, after use of Featured Listing service, or after the beginning of the provision of a digital service, cancellation or refund may not be requested unless required by law or these Terms.
17.1 The Platform is not responsible for Users’ conduct, content of listings, authenticity or validity of Registrations, or organizer decisions.
17.2 The Platform is not liable for damage arising from event changes, relocation, cancellation, refusal of transfer or entry by organizer, incorrect information from a User, inaction, fraud, breach by the other party, or limitation, outage, or decision of the Payment Partner.
17.3 The Platform is liable only for damage caused intentionally or by gross negligence where liability cannot be excluded.
17.4 Maximum liability is limited to the fee actually paid by the User to the Platform in connection with the specific service to which the damage relates.
17.5 The Platform is not liable for lost profit, indirect damage, or consequential damage unless such limitation is contrary to mandatory law.
18.1 The Platform processes personal data in accordance with applicable legal regulations, in particular GDPR.
18.2 Details of personal data processing are set out in a separate Privacy Policy, if published.
18.3 The Platform may disclose information where necessary to protect its rights, comply with a legal obligation, comply with a decision of a public authority, protect security, prevent fraud, or protect the public interest.
19.1 The Platform may amend or supplement these Terms to a reasonable extent.
19.2 The new version will be published on the Platform. By continuing to use the Platform after the effective date, the User expresses agreement with the new version.
19.3 If the User does not agree with the change, the User must stop using the Platform and, where applicable, terminate the user account.
20.1 These Terms are governed by the laws of the Czech Republic.
20.2 Disputes arising in connection with these Terms shall be resolved by the competent courts of the Czech Republic.
20.3 If any provision proves invalid or unenforceable, this shall not affect the validity and effectiveness of the remaining provisions.
20.4 These Terms become effective on the date of their publication on the Platform.
